Terms and Conditions
§1 [GENERAL PROVISIONS]
1. These terms and conditions define the rules for making purchases in the Grand Fitness online store – grand-fitness.pl, operated by Grand Piotr Brot, ul. Okrężna 39, 63-024 Krzykosy, NIP: 78616689442. The terms used in the regulations mean:
a. Customer – a natural person (with full legal capacity) or a legal entity who has made or intends to make a purchase in the Grand Fitness online store. The Customer may be either a consumer or a business entity,
b. Seller – Grand Piotr Brot, ul. Okrężna 39, 63-024 Krzykosy, NIP: 78616689442,
c. Store – the online store maintained by the Seller at the grand-fitness.pl domain,
d. Consumer – as defined by the Civil Code Act of April 23, 1964 – a User who, as a natural person, enters into a legal transaction not directly related to their business or professional activity. For the purposes of these Terms and Conditions, sole proprietors entering into non-business-related contracts are also considered consumers,
e. User Account – an account in the Store assigned to a specific Customer, containing the data provided during registration,
f. Terms and Conditions – this document, including all annexes.
2. The Store offers retail sales via the Internet of sports and fitness equipment. These products are available through the Store as ready-made items, custom orders, or personalized items.
3. Detailed product information is available on the website grand-fitness.pl and via email upon request at the Seller’s contact email.
4. The Customer may contact the Seller by post at the address specified in point 2b or by email at piotrgrandfitness@gmail.com.
§2 [SERVICE USAGE CONDITIONS]
1. To place an order through the Store, the Customer must meet the following technical requirements:
a. Have a computer, laptop, or other device with Internet access,
b. Have access to an email account,
c. Use a web browser (latest version recommended),
d. Use a minimum screen resolution of 1024×768,
e. Enable cookies in the web browser.
2. The online store provides electronic services, including:
a. User Account registration and maintenance,
b. Order form submission,
c. Newsletter subscription,
d. Contact form submission.
3. The Store does not charge any fees for these services.
4. These services are provided indefinitely. The Customer may cancel a service at any time by sending an appropriate email to the Seller. The Customer may withdraw from the contract for each service within 14 days from the order date.
§3 [CONTRACT FORMATION]
1. The contract is concluded between the Seller and the Customer.
2. All prices displayed on the Store’s website are gross prices (including VAT) and are listed in Polish zloty. Product prices do not include shipping costs.
3. The Seller ensures that product images accurately reflect their color, texture, and condition. However, due to variations in screen resolution, calibration, brightness, or use of a flash, actual colors may differ slightly from the images. Each product includes a description specifying its color. If in doubt, please contact the Seller.
4. Orders can be placed through the Store’s website using the Order Form (without registration) or via a User Account. The Seller does not conduct sales via phone or email.
5. To place an order, the Customer selects products in the Store by clicking the appropriate button. After selecting products, the Customer proceeds to the checkout page to specify the delivery and payment methods.
6. The Customer clicks the "Buy and Pay" button, which redirects them to an order summary page displaying details such as product specifications, total price (including taxes and shipping fees), and Customer information.
7. To complete the order, the Customer must confirm it by clicking the "Buy and Pay" button.
8. Clicking the "Buy and Pay" button constitutes the Customer's declaration of intent to place an order and the obligation to pay.
9. The sales contract is concluded when the Customer confirms the order by clicking the "Buy and Pay" button.
10. After placing an order, the Seller sends an email confirmation containing order details, including product specifications, delivery time, total price (including taxes and shipping fees), and Customer information.
11. The contract content is stored and secured by:
a. Providing these Terms and Conditions on the Store’s website,
b. Storing the contract details in the Store’s IT system.
12. The Seller reserves the right to refuse an order if the Customer’s contact details are false.
13. For custom or personalized products, the Customer places an order through the Store and then provides specific instructions for customization in the order notes.
§4 [PAYMENT TERMS AND METHODS]
1. The Store offers the following payment methods:
a. Bank transfer to the Seller’s account (prepayment),
b. Payment via an external payment provider (prepayment),
c. Cash on delivery,
d. Payment upon personal pickup.
2. The Customer must complete the payment within 3 business days of purchase.
3. In case of a refund, the Seller will return the payment using the same payment method originally used by the Customer.
§5 [DELIVERY METHODS AND COSTS]
1. The Customer bears the cost of product delivery to the specified address.
2. Products are delivered to addresses within the European Union. Delivery costs are displayed in the checkout panel and the order confirmation email.
3. The Seller offers the following delivery methods:
a. Courier service,
b. Polish Post,
c. Personal pickup.
4. Order processing time is between 3 to 60 business days after payment confirmation or, in the case of card payments, after successful authorization.
§6 [RIGHT TO WITHDRAW FROM THE CONTRACT]
1. This section applies only to Customers who are Consumers.
2. Consumers may withdraw from the contract within 14 days of receiving the order without providing a reason.
3. The withdrawal statement can be submitted via the withdrawal form at the end of these Terms and Conditions, by post to ul. Okrężna 39, 63-024 Krzykosy, or via email: piotrgrandfitness@gmail.com.
4. Sending the withdrawal statement within the deadline is sufficient for effectiveness.
5. The Seller confirms receipt of the withdrawal statement via email.
6. The Consumer must return the purchased products within 14 days of submitting the withdrawal statement.
7. Upon withdrawal, the contract is considered null and void.
8. The Consumer bears the direct cost of returning the products.
9. The Seller must refund the Consumer within 14 days, including product costs and delivery fees (excluding additional costs from selecting a more expensive delivery method). Refunds are processed using the same payment method unless otherwise agreed.
10. The Seller may withhold the refund until receiving the returned product or proof of its return.
11. The right of withdrawal does not apply to:
a. Custom-made or personalized products,
b. Sealed goods that cannot be returned for health or hygiene reasons after opening,
c. Items that become inseparably combined with other items after delivery.
